web site. Naturally this now includes most of the legislation that is still in force which we will call current.
Whilst, for much of the time, the provisions to be found in current Acts are the controlling factor in a particular circumstance, it must be born in mind that in some circumstances the provisions of an Act that was in force on a previous occassion, such as when a property was first purchased, might be more relevent. In all cases of doubt a qualified and insured lawyer should be consulted.
Great care should be taken when referencing Acts of parliament as can be illustrated by the commonly quoted "Section 20".
Section 20 is the name commonly given to the notice served on leaseholders by landlords when inviting them to comment upon proposals to do work. The Section 20 refered to is Section 20 of the Landlord and Tenant Act 1985. This section was actually replaced by section 151 of the Commonhold and Leasehold Reform Act of 2002 (referenced below) but the title 'Section 20' is retained.
Some protection against these anomalies can be gained by referring to all the "legislation repealed by this Act" sections of all subsequent Acts. This can be time consuming and to do so pre-supposes that a list of all these Acts is to hand. The browser through these pages should be aware that this is not such a comprehensive list.
