The changes envisaged are a small part of the comprehensive overhaul of the judicial system that has been pursued over the years of the New Labour Government since 1997. The Lord Chancellor, Lord Irvine, appointed Sir Andrew Leggatt, a retired appeal court judge, to head a wide-ranging, independent review of tribunals in England and Wales. The last such review took place in 1957 under the chairmanship of Sir Oliver Franks. "The Tribunals system has for too long been ignored. Significant steps have been taken to modernise the civil and criminal justice systems. It is high time that we also looked afresh at the whole system of administrative justice, which has a colossal impact on the lives of well over 470,000 people every year. "It is astonishing to see the extent to which tribunals have expanded since they were last reviewed in 1957." Since then he said "from the 30 or so tribunals of the 1950s we now have close on 100. Tribunals have been joined by Ombudsmen and many other regulatory bodies, which have similar judicial functions. The administrative justice system now handles more cases than the civil courts. "It is also very diverse: the largest tribunal hears over 300,000 cases a year; some rarely sit. Some are based on a presidential structure, some are regional. Some panels are legally qualified. Some are not. Some are very formal, with legal representation common. Many are not." The current consultation is a stage in the process of putting into place the Sir Andrew Leggatts recommendations. Answer: Reform of the justice system is one of this Government's priorities. Since 1997 we have implemented major improvements in the criminal and civil courts. In 2000 I asked Sir Andrew Leggatt to review the tribunal system. We published Sir Andrew's radical blueprint for reform - Tribunals for Users: One System, One Service - in August 2001. Since then the Government has been determining how best to meet the challenge set by Sir Andrew. We have taken a wide range of views, including through a formal consultation exercise. Of these, the Immigration Appellate Authority, the Office of the Social Security and Child Support Commissioners, the Tax Appeals Tribunals, the Pension Appeals Tribunal, and the Lands Tribunal already form part of my Department. The Appeals Service, Employment Tribunals Service, Mental Health Review Tribunal for England, Special Educational Needs and Disability Tribunal for England, Criminal Injuries Compensation Appeals Panel will transfer to the LCD over the period 2004/5-2007/8 from their current parent Departments. Where appropriate, other smaller tribunals will also join the new service. The Government will publish a White Paper later this year on the reform and modernisation of the tribunals justice system within an increasingly unified tribunals service. Motivation behind the proposed re-organisation would seem to be top driven and not by pressure from users. Reassuringly there is due emphasis placed upon the need for continuing independence of the Judiciary from the Legislature. Item 27 states The Government proposes that on the establishment of the Valuation Tribunal for England, the 56 separate tribunals would cease to existthe 56 tribunals were formally transferred to the VTS on its establishment in April 2004. There is no list of these tribunals within the consultation paper but they are listed on the Valuation Tribunal Service web site. Each of the 56 tribunals deals with a different area of the country. In their own areas the tribunals deal with the following issues:- non-domestic rating, completion notices, council tax valuation, drainage assessments, council tax liability, penalties for failure to provide requested information. Glossary Primary legislation is legislation made by the legislative branch of government. In the UK this is done through an Act of Parliament. Secondary legislation is made by the executive branch of Government, usually within boundaries laid down by the legislature. In the case of housing and tenancy issues the particular branch of the legislature concerned would be the Department of Communities and Local Government (DCLG) This takes various forms such as Statutory Instruments (SI) and Regulations Regulatory framework of public bodies as they affect UK housing. The role of the Public Accounts Commission is defined by the National Audit Act 1983. The Commissions principal duties under the Act are to examine the National Audit Office Estimates, to consider Reports from the appointed auditor of the National Audit Office, and to report from time to time. The Comptroller and Auditor General provides continuing advice to the Commission on these resource issues. But since by statute the Comptroller and Auditor General has complete discretion in the discharge of his functions, the Commission does not involve itself in the day to day running or administration of the National Audit Office. When necessary hearings can be arranged anywhere in England and Wales subject to the availability of courtrooms. There are separate Lands Tribunals for Scotland and for Northern Ireland.  HYPERLINK "http://www.landstribunal.gov.uk" http://www.landstribunal.gov.uk Residential Property Service (RPTS) The Residential Property Tribunal Service ("RPTS") is the umbrella organisation for the five regional offices called Rent Assessment Panels which provide an independent, fair and accessible tribunal service in England for settling disputes involving private rented and leasehold property through: Rent Assessment Committees: which determine disputes about fair and market rents Leasehold Valuation Tribunals: which determine disputes involving leasehold property Residential Property Tribunals: which determine certain appeals against denial of the Right to Buy The Committees and Tribunals under the RPTS umbrella are quasi-judicial bodies, which means that Government legislation has given them the powers to settle certain types of dispute which would otherwise have to be dealt with by the Courts. Through its Committees and Tribunals the RPTS aims to provide an easier and generally cheaper access to justice. While there is a scale of fees for some, but not all, types of leasehold dispute, there is no fee for dealing with disputes about Market or Fair rents or appeals against the denial of the Right to Buy. Rent Assessment Panels do not have the power to deal with all types of dispute about rents and leasehold matters.
