╨╧рб▒с>■  .0■   -                                                                                                                                                                                                                                                                                                                                                                                                                                                ье┴7 Ё┐LbjbjUU ,$7|7|L      lЁЁЁЁЁЁЁVVVV b,d╢ЪЪЪЪЪЪЪЪухххххх$ :░ ЁЪЪЪЪЪ d ЁЁЪЪd d d Ъ ЁЪЁЪуd Ъуd Цd · ╗ЁЁуЪО b#Ты┐╞RVд╙у40d█ък ║ъуd ЁЁЁЁ┘THE SOCIAL LANDLORDS MANDATORY REDUCTION OF SERVICE CHARGES (ENGLAND) DIRECTIONS 1997 The Secretary of State for the Environment in the exercise of the powers conferred on him by sections 219 and 220 of the Housing Act 1996a and of all other powers enabling him in that behalf, hereby gives the following Directions - Citation, Commencement and Application 1.1 These Directions may be cited as the Social Landlords Mandatory Reduction of Service Charges (England) Directions 1997 and shall come into force on 25 February 1997. 1.2 These Directions shall apply to social landlords making a service charge which - (a) is payable by a lessee in respect of a dwelling in England, and (b) is for the costs of works of repair, maintenance or improvement undertaken wholly or partly with relevant assistance from a programme specified in paragraph 2 of these Directions, in a case where an application for assistance from a programme is made on or after the date these Directions come into force. Interpretation 2. In these Directions - УbenefitФ means an increase in the value of the lease (including any reduction in a 1996 c.52. 1 the negative value of the lease) which arises from the works of repair, maintenance or improvement; УprogrammeФ means a programme of Government assistance under section 126 of the Housing Grants, Construction and Regeneration Act 1996a which is or has been designated under the titles УSingle Regeneration Budget Challenge FundФ or УEstates Renewal Challenge FundФ; Уrelevant assistanceФ means that part of a grant or other financial assistance of any kind from any of the programmes which is used for the costs of works of repair, maintenance or improvement. Mandatory Reduction of Service Charge 3.1 Subject to paragraphs 3.2 and 4 where - (a) a social landlord makes service charges in respect of the costs of works of repair, maintenance or improvement which have been or are to be undertaken wholly or partly with relevant assistance, and (b) such service charges and any service charges which the social landlord proposes subsequently to make for costs incurred in respect of such works exceed a total sum of г10,000 in respect of the same dwelling in any period of five years, a social landlord shall reduce such charges to a total sum of г10,000 in that period of five years. Where a social landlord considers that the works of repair, maintenance or improvement have resulted in a benefit to the same dwelling exceeding г10,000 in the same five year period and the social landlord has Ц a 1996 c.53. 2 (a) sent to the lessee written details of the calculation of the benefit and given the lessee not less than 28 days from receipt of the calculation to make representations on the calculation, and (b) considered any representations by the lessee, and (c) sent to the lessee written notification of the decision on the lesseeТs representations, subject to paragraph 4, a social landlord shall not be required to reduce charges under paragraph 3.1 provided that the social landlord shall reduce such service charges to an amount that does not exceed the benefit. 4. Where the maximum service charge to be made in respect of the same dwelling in any period of five years for the costs of works of repair, maintenance or improvement undertaken wholly or partly with relevant assistance is - (a) specified in an application for assistance from a programme as a sum below г10,000, and (b ) the application is approved, and (c ) the Secretary of State agrees that the maximum service charge will be the sum specified in the application or such other sum below г10,000 as may be agreed by the Secretary of State; a social landlord shall reduce any service charge so that it does not exceed tile agreed sum.
